The Federal High Court, Asaba today, 6/3/2019, closed the case between Chief Cyril Ogodo, the factional chairman of the All Peoples Congress (APC) Adams Oshiomhole, the Independent National Electoral Commission (INEC) and Prophet Jones Ode Erue, the other factional chairman of the party.
Justice T.B. Adegoke declared the case closed at the end of the examination in chief by the defendant’s witness and fourth defendant, and the cross examination by the plaintiff’s counsel, Barrister O.J. Oghenejakpor who grilled Erue for about two and half hours.
The judge also adjourned till Tuesday, March 12, 2019 for address of the court by the various counsels in the case.
In the suit, Chief Ogodo is seeking among about 23 other reliefs, a declaration that he is the authentic chairman of the APC in Delta State, and that any and every action purportedly taken, initiated or carried out by the fourth defendant, Prophet Jones Erue as chairman of APC (first defendant) by the second defendant (national Chairman, Adams Oshiomhole) in Delta State following his purported inauguration, swearing-in and recognition and/or appointment by the National Chairman as chairman of APC in Delta State is/and null, void and of no effect.
And today, the plaintiff’s counsel O.J. Oghenejakpor esq., in his cross examination of Prophet Erue put it to Erue that it was he (Erue) and one other that ran away with the documents for the ward and local government congress.
Erue was shown the report in Exhibit F page 15 to 18. Although Erue denied knowing anything about the report , which he was compelled to read to the hearing of the court. Barrister Oghenejakpor then put it to Erue, saying that the report indicted him and other committee members, saying that the report stated that Prophet Jones Ode Erue and others “eloped” with the result sheets.
Again, Barrister Oghenejakpor after more cross examination questions then put it to Prophet Erue that “your (Erue’s) tenure expired on the date that the state congress of was conducted.” Erue disagreed, saying it was “false, pointing out that the National Executive Committee (NEC) of the party gave them a waiver to stay on for some time.
Told that the state APC exco was not dissolved, Erue said it was true, and he denied playing any role in electing the APC candidates for the 2019 elections. He said: “I did not play any role as it was the duty of the NWC, which adopted the indirect system.”
At this moment, Barrister Oghenejakpor put it to Erue, saying: “Erue’s executive is an illegal executive.” Erue said it is not true.
And Oghenejakpor also told Erue that “any candidate of APC in Delta State purportedly endorsed by the Erue APC”, and Erue said “No.”
