Curtain has finally drawn to end the legal feud over the March 18, 2023 Delta State Governorship elections as the Supreme Court Friday morning put paid to the prolonged bitter row by affirming Governor Sheriff Oborevwori as the duly elected Governor of Delta State.
The apex court in a unanimous decision of a five-man panel delivered by Justice Inyang Okoro dismissed the claims of the All Progressives Congress (APC) governorship candidate and former deputy senate president, Ovie Omo-Agege challenging the declaration of Sheriff Oborevwori as Governor Delta State for lack of merit.
Justice Okoro held that Senator Omo-Agege failed to prove his over voting and non compliance to the Electoral Laws allegation, pointing out that the burden of proof was on Appellant to prove.
On Omo-Agege’s contention that the total number of INEC forms were removed, the Justices held it would still not affect the margin of lead garnered by Oborevwori’s votes at the ballot. Consequently, the suit was dismissed without cost.
Two other separate cases filed by the Social Democratic Party (SDP) candidate, Chief Kenneth Gbagi and his Labour Party governorship candidate, Pela, also suffered the same fate as they were both dismissed at different times and the election of Oborevwori affirmed as the winner.
The Court held that there’s no “singular merit” in all the issues raised by Gbagi.
Reacting, a Deltan, Mr. Onoriode Samuel said in pidgin language jocularly in Asaba that now that the cases are over, may be the Ukodo we de for fire since go don.
