The senatorial ambition of the former governor of Delta state, Dr. Emmanuel Uduaghan has suffered a major setback as a Federal High Court sitting at the Nyanya Judicial Division in Court 9, Abuja, before Justice U.P. Kekemeke declared that the Process that produced the Delta South Senatorial Candidate (Dr. Emmanuel Uduaghan) of the 1 st Defendant (All Progressive Congress) for the 2019 General Election DID NOT CONFORM to the Mandatory Provisions of Section 87 (1), (2), (3) and (4) of the Electoral Act.
IT IS FURTHER DECLARED that the 1 st Defendant (APC) cannot validly submit the name of a candidate to the 2nd Defendant (Independent National Electoral Commission, INEC) for the purpose of the 2019 General Election with respect to the Delta South Senatorial District WITHOUT complying with the Mandatory Provision of Section 87 (l)/ (2), (3) and (4) of the Electoral Act as Amended.
“THE DEFENDANT (APC) IS HEREBY ORDERED to conduct a Primary Election in the Delta
South Senatorial District in conformity with the Provisions of Section 87 of the Electoral Act WHILE the 2nd Defendant (INEC) is ORDERED to MONITOR the said Primaries,” the judge declared and awarded the cost of N 100,000 in favour of the Claimant against the 1 st and 2nd Defendants severally.
