Rivers High Court Bars Assembly, Chief Judge From Impeachment Steps Against Fubara

A Rivers State High Court sitting in Port Harcourt has issued an interim injunction restraining the Speaker of the Rivers State House of Assembly, Rt. Hon. Martin Chike Amaewhule, and 32 others—including the Clerk of the House and the Chief Judge of the state—from taking further steps toward the impeachment of Governor Siminalayi Fubara and his deputy.

In the interim order, the court specifically restrained the Chief Judge of Rivers State, Justice Simeon Chibuzor-Amadi, from receiving, forwarding, considering, or acting on any request, resolution, articles of impeachment, or related communication from the 1st to the 27th defendants for the purpose of constituting a panel to investigate alleged misconduct against the governor and deputy governor, for a period of seven days.

The order was granted by the presiding judge, Justice F.A. Fiberesima, while ruling on a motion ex parte filed in two separate suits instituted by Governor Fubara and his deputy, Professor Ngozi Nma-Odu.

Justice Fiberesima also granted leave to the claimants/applicants to serve the interim order, originating processes, and all subsequent court processes on the 1st to the 31st defendants by pasting them at the gate of the Rivers State House of Assembly Quarters.

The court further directed that the processes meant for the 32nd defendant, the Chief Judge of the state, be served through any staff of the judiciary at the Chief Judge’s Chambers within the High Court premises.

Following the ruling, the court adjourned the matter to January 23, 2026, for hearing of the motion on notice.
